Bill Title: Relating to classification of controlled substance offenses; and declaring an emergency.
Catchline/Summary: Defines "marijuana" and "marijuana product." Reduces unlawful manufacture of marijuana to Class B felony.
Punishes by maximum of 10 years' imprisonment, $250,000 fine, or both. Reduces unlawful possession of four ounces or more of marijuana to Class C felony. Punishes by maximum of five years' imprisonment, $125,000 fine, or both. Reduces unlawful possession of one ounce or more but less than four ounces of marijuana to Class B misdemeanor. Punishes by maximum of six months' imprisonment, $2,500 fine, or both. Reduces unlawful possession of less than one ounce of marijuana to Class B violation. Punishes by presumptive fine of $260.] Reduces unlawful possession of one-quarter ounce or more of marijuana product to Class C felony. Punishes by maximum of five years' imprisonment, $125,000 fine, or both. Reduces unlawful possession of less than one-quarter ounce of marijuana product to Class B misdemeanor. Punishes by maximum of six months' imprisonment, $2,500 fine, or both. Amends exceptions to classification of Schedule I and Schedule II controlled substances to reflect rescheduling of methamphetamine and marijuana. Declares emergency, effective on passage.
